DMCA & Copyright Notice
Designated copyright agent, statutory notice requirements, and takedown procedures.
1. Digital Millennium Copyright Act Policy
Nina.Sucks respects the intellectual property rights of others and expects all users and blog operators to do the same. In accordance with Title 17, United States Code, Section 512(c), copyright owners or their authorized agents may submit a formal takedown notice to our designated Copyright Agent.
2. Submitting a DMCA Takedown Notice
To file a legally sufficient notice of copyright infringement under 17 U.S.C. § 512(c)(3), you must provide written communication containing the following elements:
- A physical or electronic signature of a person authorized to act on behalf of the owner of the copyright interest.
- Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works.
- Identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate the material (including exact URLs or Post IDs).
- Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and an electronic mail address.
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
3. Counter-Notification Procedure
If you believe your content was removed by mistake or misidentification, you may submit a counter-notification under 17 U.S.C. § 512(g)(3) containing:
- Your physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before removal.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your name, physical address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if outside the U.S., for any judicial district in which the service provider may be found).
4. Repeat Infringer Policy
In accordance with the DMCA and other applicable laws, Nina.Sucks maintains a strict policy of terminating, in appropriate circumstances and at our sole discretion, accounts of users who are determined to be repeat copyright infringers.
